Licensing model: Federal authorisation by the Secretaria de Prêmios e Apostas (SPA/MF) under Law 13.756/2018 and Law 14.790/2023, which covered both sports betting and online games. Medida Provisória 1.394/2026 (25 September 2026) prohibits fixed-odds betting nationwide and brings the authorisations to an end.
Until the measure, operators needed an SPA/MF authorisation (reported at R$ 30 million for five years) and a local presence in Brazil. While the measure is in force, no company may lawfully offer fixed-odds betting, including online games, to people in Brazil.
The minimum gambling age in Brazil is 18.
Tax: The tax rules that applied to authorised operators and players under Law 14.790/2023 no longer have practical effect while Medida Provisória 1.394/2026 is in force. Nothing here is tax advice; speak to a Brazilian tax adviser about past winnings.
Advertising: Medida Provisória 1.394/2026 prohibits the advertising and intermediation of fixed-odds betting in Brazil, and set a deadline of 5 October 2026 for removing advertising and sponsorship material.
